Artist Agreement

You retain 100% ownership of every image you upload, including all copyright, moral rights, and other intellectual property rights, worldwide. Nothing in this agreement transfers any ownership to Zebbly LLC. Uploading to Pippy Post never makes your work ours.

By uploading artwork, you grant Zebbly LLC a non-exclusive, worldwide license: exercisable through the service providers we use to operate Pippy Post, such as our image host and email delivery provider, to:

• display your artwork within the Pippy Post service (marketplace pages, previews, thumbnails, your artist profile);
• reproduce and transmit your artwork as digital greeting cards delivered on behalf of subscribers (currently by email), and in the previews subscribers receive; and
• use your artwork to market and promote Pippy Post, for example on our website, social media, and advertising, with attribution to you by name wherever reasonably practicable. Marketing use is royalty-free; payment for greeting sends is covered in Section 4.

That is the entire scope. This license does not permit us to: sell or sublicense your artwork to third parties for any other purpose; produce physical merchandise or prints; or use your artwork to train artificial-intelligence models. Any use beyond the scope above requires your separate written permission.

To be precise about AI: we use AI tools to analyze artwork, suggesting style tags, matching a greeting to an occasion, and assisting moderation. We do not use your artwork to train AI models, and we do not license it to anyone else for that purpose.

The license is non-exclusive. You may sell, license, print, or display the same work anywhere else, other marketplaces, galleries, your own store, with no restriction from us, at any time, including while it is listed on Pippy Post.

You set a price per send for each image (or offer it free). Each time a subscriber's greeting uses one of your priced images, you earn that price minus your platform fee. Earnings are paid to your connected Stripe account monthly, on or about the 15th, for sends whose sender has been billed; a send whose sender has not paid is held, not lost. Artists joining now pay no platform fee and keep 100% of the price they set. Your current fee is shown in your artist dashboard. We may change the fee for future earnings with the notice described in section 10, and any change applies only from its effective date — anything you have already earned is never affected. Free images generate no payout. You are an independent artist, not an employee or agent of Zebbly LLC, and you are responsible for your own taxes; Stripe issues 1099-K or equivalent forms where required.

Business licensing. Some Pippy Post customers are businesses who send greetings to their own clients. Your work can be licensed for that, and you are paid for it. Because a business sends to hundreds or thousands of people at once, business licences are priced in bulk, the way volume is priced anywhere. The rate per greeting is lower than your per-send price, and the total you earn is considerably higher. A business pays once for one year of use on their own list:

• 25× your per-send price — lists up to 250 clients
• 60× your per-send price — lists up to 1,000 clients

The licence fee is paid up front and does not depend on how much they send. A business that licenses your work and then sends three greetings all year pays exactly the same as one that sends three thousand. The per-greeting figures below are only arithmetic after the fact; what you are paid is the annual fee, in full, at the start of the term. The fee also does not shrink when a business has a short client list: a small business pays the same as a large one on the same tier, so you are never paid less because they had fewer people to send to. No licence is ever less than $40.00 or $90.00 for the tiers above, however you have priced your per-send rate.

A $2.00 image therefore licenses at $50.00 or $120.00 a year. You keep the same share of a licence fee as you do of a per-send price, and the licence renews annually unless the business cancels.

A business licence covers one use and nothing else: sending greetings through Pippy Post to that business's own client list. It does not let them put your work on their website, social media, printed material, advertising, signage, packaging, merchandise, or anything they sell. They may not download it for other use, alter or crop it, pass it on to anyone else, remove your name from it, or present it as their own or as work they commissioned. Those limits are written into the Terms of Service that every business accepts, and breaking them is copyright infringement you remain free to pursue. If a business wants your work for any other purpose, they have to come to you directly and agree it with you — we take no part in that and no cut of it.

What you would earn from a licence is shown next to the price whenever you set one, so you always know what you are agreeing to before you publish a piece.

Business licences are non-exclusive — the same image may be licensed to more than one business, and you may keep selling and licensing it anywhere else. Your attribution travels with the image under section 2, including when a business sends under its own branding. If you would rather a piece were not licensed commercially, remove it under section 5 — removal stops new licences immediately, and any licence already running finishes its term and pays out normally.

You may remove any image from Pippy Post at any time. Removed images immediately stop being selectable for new greetings. Greetings already scheduled or in delivery with your image will complete (and pay out normally), and we will stop using your artwork in new marketing and phase it out of active marketing materials within a reasonable period. Marketing already published, for example past social posts, may remain. Removal does not affect payments already earned.

You represent and warrant that each image you upload is your original work (or that you hold all rights needed to grant this license); that it does not infringe anyone's intellectual-property, privacy, or publicity rights; and that it complies with our content standards, in particular, explicit, adult, or sexually suggestive content is not permitted, and all artwork must be appropriate for a general audience.

Every upload is reviewed before it can appear anywhere in the service. We may decline or remove artwork that violates this agreement, our content standards, or applicable law. Repeated violations may result in removal from the artist program.

This agreement applies from your first upload and continues while you have artwork on Pippy Post. Either party may end it at any time, you by removing your artwork or closing your artist account, us by written notice. Sections 1 (your ownership), 4 (amounts already earned), 6 (your warranties, for the period your work was live), and 9 (indemnification for that period) survive.

Because only you know the provenance of your work, you agree to defend and indemnify Zebbly LLC against third-party claims arising from a breach of your promises in Section 6, for example, a claim that artwork you uploaded infringes someone else's rights. We will tell you promptly about any such claim, let you control the defense with counsel of your choosing, and cooperate with you. We will not settle a claim in your name without your consent. Your responsibility is limited to claims about your own artwork; it does not extend to how we operate the service.

We may update this agreement. For material changes we will give you at least 30 days' notice by email. If you keep artwork on Pippy Post after a change takes effect, the updated agreement applies to it; if you would rather not accept it, remove your artwork before the effective date and the prior terms govern everything up to that point. Payments already earned are never affected by a change.

This agreement is governed by the laws of the State of Connecticut. If any provision is found unenforceable, the rest remains in effect. This agreement works alongside our Terms of Service and Privacy Policy; if this agreement and the Terms of Service conflict about artwork rights, this agreement wins.
